Abstract

Problem setting. The transformation processes in Ukraine did not lead to the legal economy formation, it is therefore necessary to identify the main development obstacles of the legal economy and figure out ways to overcome them.
Recent research and publications analysis. The theory of constitutional economics developed by J. Buchanan, B. Ackerman, F. Farina, N. Berggren, W. Block, and T. DiLorenzo and other. The development of the constitutional economy theory in the conditions of transformation system was carried out by H. M. Andreieva, P. D. Barenboim, H. A. Hadzhyiev, S. Yu. Danylov, P. O. Dobrodumov, V. D. Mazaiev and other. However, the issues of state and prospects of legal economy development in the Ukraine has not received a final decision.
Paper objective. The article objective is to disclose state and prospects of legal economy development in the ukrainian system of income formation.
Paper main body. In Ukraine a major role in the processes of income distribution and redistribution plays an informal interaction of business and government. For the legal economy development is needed to realize a set of reforms «spheres – procedure – bodies – frames – control».
The first component provides for the reduction of the economy sectors, on the basis of which corruption relations are actively developing.
Change of work procedures of the public authorities provides for a comprehensive economy deregulation, transition to the automatically acting regulators and radical reduction of the discretionary power.
The third element (bodies) first in need of the powers expansion of the newly created anti-corruption structures and the establishment of anti-corruption court.
Public bodies need to be cleaned out from corrupt frames, citizens of developed countries should be more actively involved in leadership positions.
An effective control system of income and expenditure of politicians and officials require the introduction and accountability of the government to the people should be increased.
Conclusions of the research. Instead of legal economy development in Ukraine formed the complex conglomerate of corrupt relations between business and power, which makes it impossible the formation of legal economy. The initial impetus for overcoming this conglomerate may be the pressure from Western partners, but the legal economy development is impossible without the participation of civil society institutions and the wide layers of the population.
Short Abstract for an article
Аbstract. The level of legal economy development in the Ukrainian system of income formation is characterized. Prospects of legal economy development associated with the realization possibilities of complex measures «spheres – procedure – bodies – frames – control». The author has presented the contents and ways of implementing this complex measures, as well as the main obstacles to the proposed reforms. The author sets out a possible sequence of reforms promotion.
