Abstract

 Problem setting. Systematization and determination of historical backgrounds of formation of business and legal institutions and elements in the economic law of Ukraine enable to forecast development of codification processes in the Ukrainian law.
Recent research and publications analysis. Significant input in the analysis of historical past of economic law development has been made by representatives of the Donetsk school of law — V. K. Mamutov, H. L. Znamenskyi, P. H. Skrypnyk, V. A. Ustymenko. The partial analysis of development of the economic law science during the Soviet period has been done by O. M. Vinnyk, D. V. Zadykhaylo, R. B. Prylutskyi, etc. Neverthless, the above mentioned scientists haven’t paid enough attention to issues of the impact of the Soviet economic law on the present economic and legal relations as well as on the economic law as a whole.
Paper objective. The aim of the paper refers to analysis of the content of the lawmaking activity of the state in the field of business and legal regulation at the initial stage of the Ukrainian market economy formation.
Paper objective. Market transformations in Ukraine were settled at the beginning of the 90th. These processes influenced both the position and the nature of the economic law. There is the urgent necessity to analyze phases of economic law development and
to determine the role of the codification process in the history of the economic law in order to determine further core objectives of domestic economy modernization, to establish a dogmatic subject of the present economic law, and to determine prospects of
its development.
Conclusions of the research. Economic law reconstruction for the purpose of its adjusting to market conditions was done during the transitional period. This process has become the legal basis for a preparation process of economic law systematization, which
is reflected in the Economic Code adopted on the 1 January 2004. Inevitability of the codification processes was determined and appointed by the historical past of the legal framework of the economic field.
