Abstract

Problem setting. The most favorable regions for the use of wind energy is a coastal seas and oceans, tundra, mountain areas. The area suitable for the development of wind energy covers 25 % of Earth’s surface. Given the economic, technical, environmental and other restrictions, then 2020 could be to build a wind farm with a total capacity of 450 million kilowatts, which could annually produce 900 billion kilowatt / hours of electricity. This would amount to 3.5 % of all electricity is projected to be produced.
Recent research and publications analysis. In jurisprudence considering energy issues in their works S. A. Svirkov, A. P. Vershinin, S. D. Bilotskyy and others, but the alternative energy sector remains insufficiently investigated.
Paper objective. The article aims to clarify the status and problems of legal regulation of wind power in Ukraine.
Paper main body. Start of renewable energy in Ukraine as a whole began in 2009 with the establishment of the Green Tariff Law of Ukraine «On Electric Power Industry». Wind power capacity in 2014 is 500 MW.
The legal order of regulation of wind power differs depending on their capacity. Connecting wind farms customer on the basis of the agreement on accession to power grids. The owner of power networks has the right to refuse to connect to electricity networks. Using household (to 75 kVt) wind turbine is equivalent to using diesel generators or solar panels, is equal to household appliances, so its operation does not need licenses or permits. The only document regulating the installation of wind turbines of small power (75 kW),
are the requirements to be followed when installing stationary small architectural forms.
For energy facilities that produce electricity from renewable energy sources and construction of which was started after 1 January 2012, the «green» tariff applies provided that the value of the local content.
Government policies aimed to stimulate consumers of renewable energy in foreign countries play an important role in the development of wind power. The government decision-making in Ukraine encountering bureaucratic obstacles that delay the adoption of the necessary solutions for years, powers and responsibilities are not clearly divided between different departments, there is no mechanism that would allow to evaluate the effectiveness of its implementation and reviews of market participants.
Conclusions of the research. It is necessary to form the national energy policy, legislative and technical base of renewable energy, a system of incentives for the development of wind power in Ukraine. Wind industry needs to be stimulated in three directions. The first direction is generation wind power by wind power plant and household windmills. The second direction is production equipment (competitive conditions for manufacturers). The third direction is stimulating consumers of energy. In addition to the integrated wind
energy sector Ukraine should take into account the regional location of relevant facilities and therefore develop and implement innovative investment development projects in some regions.
