Abstract |
Problem setting. Decentralization as a conceptual factor of the development of the constitutional and legislative regulation is balancing of powers of state and local authorities, expanding the list of powers of the local administrations in a given settlement. First of all, this refers to budget and tax relations in its between-the-budget context, but it would be also fare to question about a more active position of local administrations in the economic field. The problem refers to the stimulation of an influence of the local community through the local authorities on the entities functioning. Recent research and publications analysis. The problem of the economic and legislative provision of the competence of public authority bodies has become a subject to research in papers of following authors: Vikhrov O. P., Kravetz I. M., Ustymenko V. A., Jabrailov R. A., Zadykhailo D. V., Milash V. S. etc. Thus, scientific papers of the determined above authors do not contain information relating the problems of organizational and economic powers of the local administrations in the field of economy to ensure appropriate living standards. Paper objective. The article refers to actual problem of a present system of legislation on the local self-government development in the context of exact, detailed and legally correct systematization of the organizational and economic powers of such administrations in the field of economy. Paper main body. A group of subjects of the local self-administration as subjects of organizational and economic powers requires the certain convergence of the content of the legislative regulation on local self-administration and its staff together with the economic legislation in a single mechanism for their own legislative regulation, specially with regard to the requirements of the p. 19 of the Constitution of Ukraine. The article is dedicated to the scientific problem of the terms, the optimization of legal means and legal forms of the two national legislative fields — a municipal one and an economic one. Conclusions of the research. The authorities of the local self-administrations in the field of economy are suggested to be formulated in the form of the economic and legislative format, since according to the Economic Code of Ukraine the local self-administrations are determined to be the subjects of organisational and economic powers. |
