Abstract |
Problem setting. Today, juvenile prevention is regarded as an important principle of juvenile justice and the best form of ensuring the interests of the child. This causes an expansion of the system of preventive influence on the child and his environment. Recent research and publications analysis. At the scientific level, this issue was studied by G. Bejzmor, R. Spon, N. Ortynska, D. O’Mahony & R. Deazley, R. Loeber, D. Farrington, D. Petechuk, N. Lesko, S. Povolotska and other. At the same time, the analysis of the structure of juvenile prevention shows that the system of preventive influence is not complete and sufficient. Paper objective. The purpose of the article is to analyze the existing system of preventive measures (in the context of the functioning of juvenile justice), with the aim of further administrative and legal improvement of this activity. Paper main body. The article presents the structure of preventive and post-torture reaction (system of measures of primary, secondary and tertiary juvenile prevention) on the minor and his immediate social environment. The author notes a significant lack of second-level preventive measures for the category of children at risk. Given the legal experience of some other countries, it is justified to introduce into Ukrainian legislation a set of preventive care measures for a child with behavioural problems. This complex includes minimum and moderate preventative child care arrangements, as well as comprehensive assistance to family members Conclusions of the research. According to the results of the research, a number of proposals are being made to improve the system of administrative and legal (preventive) measures in Ukraine. It is proposed to: expand the list of categories of minors who are to be taken to preventive police records; to introduce into the system of juvenile technologies a set of preventive care measures for a child with behavioural problems; to establish in the system of special institutions for children children’s centres of socialization; create legal guarantees in Ukraine to protect the child from the harmful effects of negative factors of the social environment, etc. Short Abstract for an article Аbstract. Recently, along with the administration of justice, juvenile justice in the representation of Ukrainian society is increasingly emerging as a system of prevention (prevention) of the causes of juvenile deviance. This causes an expansion of the system of preventive influence on the child and his environment. Based on a critical analysis of the preventive component of juvenile justice (a three-tier structure of juvenile prevention), a number of proposals are made to improve the system of administrative-legal (preventive) measures in Ukraine. |
