Abstract

Problem setting. Today the market economy of Ukraine and the world is largely based on a fruitful relations between government and business. This type of relationship is a public-private partnership. The vast majority of electricity companies as at 2016 in Ukraine are privately owned, the need for properly constructed public-private relations is extremely relevant.
Recent research and publications analysis. Issues of public-private partnership in the fuel and energy complex have been studied by many domestic and foreign scientists: M. Avksentiev, V. Varnavskyi, O. Vinnyk, L. Hryshchenko, Delmon Dzh., R. Dzhabrailov, H. Z namenskyi, Yu. Ivanishkina, Ye. Kotov, T. Lebeda, A. Mostepaniuk, O. Pyltiai, O. Simson, V. Ustymenko, L. Fedulova, O. Khirs and others.
Paper objective. The main objective of this study is the aspects of public-private partnership, the legal framework for it in Ukraine, private investment, the targeted use of partnership in the fuel and energy sector of the country and the analysis of international practice of public-private partnership.
Paper main body. The energy structure of Ukraine requires significant modernization, since the country’s fixed assets (electrical networks, stations and substations, accounting systems, etc.) have significant wear. The Law of Ukraine “On Public-Private Partnership” provides for the implementation of projects only in the contract form. The contracts are concluded within the framework of this association, which allows for the maximum structure and transparency of the operation.
One of the main and integral part of PPP is investment, attracting private investments is one of the main objectives and signs of partnership. The fuel and energy complex recommends itself as one of the most promising areas of development and investment. Its development can give our state a chance to restore economic position and become competitive on the world market.
Conclusions of the research. In Ukraine, one can observe the first steps towards the introduction of PPP, but this path requires great efforts and changes. The disadvantages far in the proceedings of PPP are:
– weak base for providing guarantees by the state;
– impossibility of introducing a full concession relationship;
– the lack of a good plan to encourage entities in the investment projects;
– small experience of the country in the application of PPPs and an outdated mentality regarding cooperation between both sides. The fuel and energy complex of the country is just beginning its acquaintance with the orms of public-private partnership.
Short Abstract for an article
Аbstract. The article analyzes and compares the general theoretical legal provisions, problematic issues of public-private partnership, the legislative basis for it in Ukraine, private investments, the targeted use of such partnership in the fuel and energy sector of the country and the analysis of international practice of public-private partnership.
