Abstract

Problem setting. An industrial policy is one of the main directions of an economic activity of a state, which constitutes a system of measures aimed at qualitative and quantitative changes of the industrial sector and sectors related to it. An important feature of economic potential of a state is an industrial structure of an economy.
It is important to emphasize that the industrial policy of a state and the appropriate mechanism of its economic and legal framework needs new conceptual and applied approaches under modern conditions.
Recent research and publication analysis. There is a need to notice that scientistseconomists pay attention to certain directions of the state economic policy and a set of legal measures, which are inherent to the policy. Works of O. M. Vinnyk, D. V. Zadykhailo, V. V. Laptev, V. K. Mamutov, V. M. Pashkov, O. P. Podtserkovnyi, V. A. Ustymenko, V. S. Shcherbyna, O. V. Shapovalova etc. are of signifi cant importance. Notwithstanding,
the mentioned scientists do not pay a considerable attention to the problem of direct usage of measures of investment, foreign economic, antitrust and competitive, tax, monetary etc. policies of a state in the process of realization of the industrial policy.
Paper objective. The objective of the article is research of a content of the state industrial policy as an important economic and legal phenomenon.
Paper main body. The constitutional and legal and the economic and legal framework of economic policies of independent states as a politic and legal constant should contain a considerable set of legal mechanisms, which ought to reinforce resistance of a national economic body, to direct an activity of state authorities at counteraction of negative effects and consequences of the organized and the non-organized transnational segments in the world economy. There is a need to consciously and directly include the factor of real and
potential activity of transnational banks and companies and especially their unions among the categories of potential threats of the economic security.
Such framework conventionally includes two main blocks and accordingly two legal mechanisms of provision of their functioning. The fi rst one consists of formation and objectivization of the content of the state industrial policy, the second one consists of its practical realization in the system of organizational and economic relationships. Both mechanisms constitute determination of essential features of these specifi c types of a state activity, optimization of subjective content of bodies of organizational and economic powers, development and classifi cation of the economic and legal measures of influence on certain social relationships, in particular on behavior of economic entities, development of integral and purposeful legal regimes of the economy, creation of special service institutes in the process of industrial development, including entities of economic infrastructure etc.
Conclusions of the research. Consequently, the industrial policy of a state is the most synthetic phenomenon, since it focused on a status and peculiarities of development of a “supersegment” of a national economy. All other directions of the economic policy accompanied by the set of legal measures are used in the state industrial policy as instruments of its realization. Within this context there is a need to consider the problem concerned with obligation of taking into account and direct usage of the measures of
investment, foreign economic, antitrust and competitive, tax, monetary etc. policies of a state in the process of the industrial policy realization.
