Abstract

Problem setting. Public regulation in the field of health protection is a system of typical legislative, executive, and supervisory measures, which are carried out by public establishments and non-governmental organizations for the purpose of stabilization and adjustment of the current social and economic system to changing conditions. Guaranteeing social rights of citizens, namely rights for health protection, the state thereby declares that social safety can be achieved only in terms of application of mechanisms of legal
regulation.
Recent research and publications analysis. An issue of public regulation of the economic activity has been researched by domestic scientists such as O. M. Vinnyk, V. V. Dobrovolska, D. V. Zadykhailo, V. K. Mamutov, V. M. Pashkov, V. V. Reznikova, V. A. Ustymenko, O. V. Shapovalova, V. S. Shcgerbyna, etc. However, the mentioned issues have been considered only in the context of particular branches of the national economy, which are not related to the health protection field.
Paper objective. The article purpose is to research a legal mechanism of realization of patients’ rights due to means of parliamentary control.
Paper main body. The most significant documents, which are developed in Europe, includes: «A declaration on the promotion of patients’ rights in Europe», which is passed at the consultation of the World Health Organization in Amsterdam in 1994 and European charter of patients’ rights, which is passed at the consultation of large organizations of a civil society of the EU countries in Rome in November 2002.
An ombudsman for protection of patients’ rights (or another authorized body of a civil society performing its functions in this field) was created as an independent body being responsible for social control over complying with patients’ rights by members of a health protection system in the process of their interaction with citizens.
Conclusions of the research. An institution of an ombudsman for patients’ rights is an essential element of the national system of protection of human rights in the field of health protection. It is a key chain in the process of transformation in countries being on the path to democracy and supremacy of law.
