Abstract

Problem setting. Judicial reform, which began in 2016 and which provisions continue to be implemented and now in the legal system of Ukraine, brought a number of fundamental changes in the judicial system. As a result of the adoption in 2016 of amendments to the Constitution of Ukraine in the area of justice, the adoption of the new Law “On the Judiciary and the Status of Judges” and the subsequent introduction of amendments to the
procedural codes, we received the absolutely newest Supreme Court as the highest (among the three) judiciary of Ukraine with sufficiently wide opportunities to ensure the unity of judicial practice and influence in general on legal regulation. An addition to the Constitution, Article 1511 has introduced the long-awaited authority of the Constitutional Court of Ukraine to decide on the compliance of the Constitution of Ukraine (constitutionality) with the law of Ukraine on the constitutional complaint of individuals who believe that the law of Ukraine is in conflict with the Constitution of Ukraine in the final judicial decision in her or his case.
Recent research and publication analysis. These facts together with the necessity of ensuring of the legal certainty principle in Ukrainian law clearly indicates the relevance of the issue of the impact of judicial practice on legal regulation, which is confirmed by high interest among Ukrainian researchers. The high debate on this issue is connected with the lack of an established approach to the understanding of judicial practice, its role as a source of law; Even more controversial are the approaches to specific impacts of jurisprudence on law-making and legislation.
Paper objective the purpose of this article is to find out the content of the concept of “judicial practice”, is role as a source of law, and the role of the Constitutional Court of Ukraine case law in terms of ensuring its stability and dynamism.
Paper main body. Article 1 of the Law of Ukraine “On the Constitutional Court of Ukraine” of July 13, 2017 establishes that the Constitutional Court of Ukraine (hereinafter referred to as the Constitutional Court of Ukraine) is the body of constitutional jurisdiction, which is entrusted with ensuring the rule of the Constitution of Ukraine, The Constitution of Ukraine (CCU), cases of other acts, official interpretation of the Constitution of Ukraine,
as well as other powers in accordance with the Constitution of Ukraine. It is determined that the main activities of CCU are: constitutional control and official interpretation of the Constitution.
Conclusions of the research. As it is seen from the analysis of scientific literature and the case law of the Constitutional Court of Ukraine, the latter has a very powerful influence on ensuring the stability and dynamism of Ukrainian legislation. The Constitutional Court of Ukraine, consistent with the Constitution and the Law, empowers, consistently protects the values of the Basic Law, harmoniously promoting the stability of legal regulation and promoting its dynamic development.
Short Abstract for an article
Abstract. The article is devoted to the role of the Constitutional Court of Ukraine on ensuring stability and at the same time dynamism of the legal regulation system. The powers of the Constitutional Court through the implementation of which it can influence the development of the legal system are analyzed.
