Abstract

Problem setting. Ukraine belongs to the category of states that have owned a wide range of movable and immovable property. Government agencies can influence the functioning process of the whole economic system, using a significant amount of assets in the sphere of transport, communications, heavy, coal and chemical industry.
Therefore, the processes of corporatization and privatization in Ukraine became very important at the modern stage of development productive forces and production relations.
Recent research and publications analysis. D. I. Pogribnyy, N. S. Gontarenko, V. G. Ruban, I. A. Selivanova, S. V. Tomchyshen, S. N. Balina and others in their scientific works focused attention on research of the conducting process of corporatization and privatization.
Paper objective. The article purpose is to conduct analysis, generalization and systematization of the existing regulatory legal base in the sphere of privatization, the allocation of features for process of strategically important enterprises for the Ukrainian economy, and those companies that occupy a monopoly (dominant) position on a particular market of goods, works and services.
Paper main body. One way to achieve this purpose is privatization and corporatization of public property. Legal, economic and organizational basis of privatization and privatization of property of state enterprises in Ukraine are regulated by laws of Ukraine, decrees President of Ukraine, the state program of privatization, the decisions the Cabinet of Ministers of Ukraine and other normative-legal acts regulating the privatization process.
It is worth mentioning that the property privatization of state enterprises is a very complex socio-economic process. It concerns vital interests of workers in all spheres of economic activity.
As for corporatisation, it is also one of the types of privatization of state property and the preparatory stage for privatization in the future, that is, before the corporatisation of state enterprises and preparation for the sale certain percentage of shares.
Conclusions of the research. Based on the foregoing it can be concluded, that the legal regime of joint-stock companies property with state ownership, as in the case of PJSC «Ukrzaliznytsia», may only be changed through privatization.
In addition, it is possible to conduct corporatization of the assets of the railway industry in the form that has the goal of creating state holding company. The holding of such assets corporatization will be the most effective.
In addition, the establishment holding model of management assets of railway transport enterprises as one of the most effective models of governance maintains the integrity of the property complex of the company, unified management system, to carry out the allocation of assets.
Short Abstract for an article
Abstract. The article is dedicated to legal research features of the corporatization process of the natural monopolies assets and strategically important enterprises for the Ukrainian economy. The author has conducted analyze, generalization and systematization of normative legal base in the sphere of privatization and corporatization, the identification of shortcomings and workarounds, as well as determining characteristics of the implementation mechanism this process. The author focuses on the possibility of property corporatisation, which belongs to the state in the authorized enterprises capital of railway transport of Ukraine.
